HOC CONFIDENTIALITY POLICY & AGREEMENT

It is the policy of Hospice of Chattanooga, Inc. (HOC) to protect and maintain confidentiality of employee and client/patient/caregiver related health care information. HOC will ensure that Tennessee and Georgia laws are compiled with regarding HOC personnel and HOC patient medical related documents. HOC will ensure safekeeping of the information against loss, defacement, tampering or use by unauthorized individuals.

1. Any oral or written requests for medical record documents will be approved and released only by HOC Registered Health Information Technologist (RHIT), Director of Administration, or the Medical Director. No other employee of HOC is authorized to release patient medical information by any means including fax, email, oral, photo copies, or hand written to any individual or company not employed by HOC or directly involved in the patient’s care.
   
2. The RHIT and/or the Director of Administration are to be immediately notified if an oral or written request for records/documents is received by any employee of HOC. Tennessee and Georgia law requires that records be released within a specific number of days if the criteria for release are met.
  If records are to be inspected by an outside agency or individual the HOC Executive Director must authorize this inspection. Written or photo copied information taken from the records is prohibited unless approved by the Executive Director.
   
4. Removal of the original personnel or patient medical records and/or documents from the HOC property is prohibited with the exception of off-site record storage in the archive center.
   
5. Hospice employees, board members, volunteers, students, or any contracted personnel providing services for HOC will not discuss any patient/caregiver/employee record or information with unauthorized individuals or in areas where unauthorized individuals may overhear such conversation whether on or off duty.
   
6. HOC employees are responsible for securing documentation in their possession, including patient related documents in their work area. This must be done in order to prevent the documents from being seen, read, and/or removed by unauthorized individuals. HOC staff are required to lock in their desk or file any patient/employee related documents that are not ready to be filed in the medical record prior to leaving the HOC office.

I have read and understand the Confidentiality Policy completely. I also understand that my failure to comply with all aspects of the above policy may result in termination of my employment or contractual arrangement with HOC. I also understand that I may face charges of breach of confidentiality, defamation of character or other civil actions for damages sustained as a result of the violation of this policy by the signatory below.
